Event Attendee Agreement (EAA)

In return for being permitted to participate in the following activity or program (“The Activity”), including any associated use of the premises, facilities, staff, equipment, transportation, and services of the Council of Young Filipinx Americans in Medicine (“CYFAM”), I, for myself, heirs, personal representatives, and assigns, do hereby release, waive, discharge, and promise not to sue Council of Young Filipino Americans in Medicine (doing business as “Council of Young Filipinx Americans in Medicine” and “CYFAM”), its directors, officers, employees, and agents, from liability from any and all claims, including the negligence of CYFAM, resulting in personal injury (including death), accidents or illnesses, and property loss, in connection with my participation in the Activity and any use of organizational premises and facilities.

Participation in The Activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injury. The specific risks vary from one activity to another, but the risks range from 1) minor injuries such as scratches, bruises, and sprains, to 2) food- and waterborne illnesses, to 2) major injuries such as eye injury, joint or bone injuries, heart attacks, and concussions, to 3) catastrophic injuries such as paralysis and death. Kindly note that The Activity may include sessions pertaining to medical skills, including but not limited to, suturing, ultrasound, intubations, and others.

ASSUMPTION OF COVID-RELATED RISKS

I recognize that there are certain inherent risks associated with the above-described Activity regarding COVID-19, acknowledge the contagious nature of COVID-19, and understand that the Centers for Disease Control and Prevention (CDC) and public health authorities have recommendations for prevention, exposure. Testing, and infection, and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge CYFAM for injury, loss, or damage arising out of my or my family’s use of or present upon the facilities of CYFAM, whether caused by the fault of myself, my family, CYFAM, or other third parties.

MEDICAL CARE CONSENT AND WAIVER

I authorize the CYFAM to provide me with first aid and to arrange medical assistance, transportation, and emergency medical services for me if I get hurt while participating in the Activity. I understand that CYFAM is not obligated to provide this care. I also understand that I am solely responsible for any costs related to my medical treatment and transport, and that CYFAM does not provide health, medical, disability, or other insurance coverage for me.

INDEMNIFICATION AND HOLD HARMLESS

I also agree to indemnify and hold CYFAM harmless from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of my involvement in the Activity, and to reimburse it for any such expenses incurred.

SEVERABILITY

I further agree that this Waiver of Liability, Assumption of Risk, and Indemnity Agreement is intended to be as broad and inclusive as permitted by law and that if any portion is held invalid the remaining portions will continue to have full legal force and effect.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the State of Nevada, and any disputes arising out of or in connection with this Agreement shall be under the exclusive jurisdiction of the Courts of the State of Nevada.

ACKNOWLEDGMENT OF UNDERSTANDING

I have read this Waiver of Liability, Assumption of Risk, and Indemnity Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I confirm that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

CYFAM is committed to providing a safe and equal space for professional participation for all of our volunteers, partners, and event attendees. We believe that everyone has the right to professional interaction without fear, intimidation, or belittlement, and that everyone has the right to fair and equal participation and treatment.

Our strength as an association is our people, and we cherish their diversity. We value all of our members, partners, and attendees equally, and will not accept any treatment in any arena of association business which goes contrary to this.

CYFAM’s conferences and meeting events are dedicated to providing a harassment-free conference experience for everyone, regardless of gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, or religion. We have a zero-tolerance policy for hostile or harassing conduct of conference participants in any form. Sexual language and imagery is not appropriate for any conference venue, including sessions and networking events. Conference participants violating these rules may be sanctioned or expelled from the conference [without a refund] at the discretion of the conference organizers.

Harassment includes offensive verbal comments related to gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, religion, sexual images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome sexual attention. Participants asked to stop any harassing behavior are expected to comply immediately.

Exhibitors in the sponsor or vendor booths, virtual and in-person venues, or similar activities are both protected by and subject to the anti-harassment policy. In particular, exhibitors should not use sexualized images, activities, or other material. Booth staff (including volunteers) should not use sexualized clothing/uniforms/costumes, or otherwise create a sexualized environment.

CONSEQUENCES

If a participant engages in harassing behavior, the conference organizers may take any action they deem appropriate, including warning the offender or expulsion from the conference with no refund, and forfeiture of roles on boards or committees.

USE BY THE ORGANIZATION OF MY NAME AND IMAGE

I understand that the CYFAM may take photos or videos of me during the Activity. I consent to use by CYFAM of my image, voice, name, and story (collectively, “Materials”), in CYFAM’s digital and print promotional, fundraising, educational, and other communications. CYFAM may use the Materials without obtaining my approval or paying me for such use. I grant CYFAM all copyrights in and waive any legal claims relating to the Materials, including those relating to copyright, rights of publicity or privacy, or defamation, or arising from any distortion, blurring,or alteration that may occur in the making, editing, or use of the Materials.
